The Tallinn Administrative Court today issued a preliminary injunction approving the application by Ühisarveldused AS (register code 14192799) for temporary legal protection that suspended until 22 September the decision taken by Finantsinspektsioon on 18 August to withdraw the licence from Ühisarveldused AS. This means that Ühisarveldused AS temporarily remains a payment institution under a licence issued by Finantsinspektsioon on 11 June 2018 under the Payments and E-money Institutions Act to provide the payment services listed in § 3 (1) 1)-6) of that act. Ühisarveldused AS was issued the identifier code number 02 on 11 June 2018.
The preliminary injunction providing legal protection issued by the Tallinn Administrative Court is a temporary measure for which the court only considered the need of Ühisarveldused AS for that protection. The court gave Finantsinspektsioon a deadline to respond to the preliminary injunction. Finantsinspektsioon believes that the preliminary injunction is not in the public interest and will submit its position to the court by 15 September at the latest, after which it will be decided whether the injunction will remain in place or not.
Finantsinspektsioon will announce further developments in response to the decisions of the court and its legal obligations.
